Granting a License.
If you comply with these Terms of Use, we grant you a non-exclusive, non-transferable license to use one copy of the applicable version or release of the Software solely for your personal use or for use within your organization. This license is subject to any applicable Software license information contained in the Software products or accompanying documentation.
Your use of the Software is subject to the following restrictions, unless expressly permitted in the accompanying documentation:
You may not use the Software to provide services to third parties.
You may not copy, distribute, resell, or sublicense the Software to others.
These Terms of Use do not convey ownership of any intellectual property rights.
We reserve the right to publish information about licensees (including company names and logos) in marketing and public relations materials on our website or in relevant publications without obtaining additional consent from the Software user.

Limitation of Liability.
Tap Medical’s liability to you under this Agreement is limited to the amount you paid to Tap Medical for your subscription to the applicable Software for the current calendar month, or to the remaining balance of any prepaid monthly subscription fees paid for multiple calendar months.
To the maximum extent permitted by applicable law, you and Tap Medical are not liable for lost profits, downtime damages, loss or corruption of data, or any indirect, incidental, consequential, special, or derivative losses or expenses.

Commencement and Termination.
These Terms of Use between Tap Medical and the user(s) become effective upon the user creating an account for the Software.
These Terms of Use remain in effect until terminated or expired. However, your rights under these Terms of Use will terminate immediately if you fail to comply with any of their provisions.
6.
Warranties of Use.
We warrant that the Software will operate substantially in accordance with the documentation provided. This warranty is your exclusive remedy and is provided in lieu of all other warranties, whether express or implied. The user assumes all risks associated with the use, results, and operation of the Software programs.

Free Version.
We understand that you may not wish to disclose personal information when trying our Services. Therefore, we offer a free version of the Software. Any content you create using the free version will be available only within your account. Your personal and confidential information remains secure while you use the free version to explore and better understand the Software’s features.

Personal Information.
During the registration process for creating an account, we request your name and email address. You will also be asked to choose a unique username and password, which will be used solely to provide access to your account. Your name and email address may be used to notify you about new services, software releases, upcoming events, and changes to the Software.

As a result, your files and data may remain on our servers even after deletion or termination of your account.
We assure you that the contents of your account will not be disclosed to anyone and will not be accessible to our employees. Additionally, we do not process the contents of your account for targeted advertising purposes.

Financial Information.
For services requiring payment, we may request your payment card or other payment account information, which will be used solely for processing payments. Your financial information is not stored by us. With your prior consent and only when necessary for processing future payments, your financial information may be stored in encrypted form on the secure servers of a reputable payment gateway service provider.

We collect information such as IP address, browser type, browser language, referring URL, accessed files, errors generated, time zone, operating system, and other visitor details in our log files. It is the responsibility of users of the Software to ensure compliance with applicable laws and regulations regarding the storage and processing of personal and medical data.
We provide a secure technological environment for handling, maintaining, and storing sensitive medical information, in compliance with HIPAA, SEC Rule 17a-4(f), K-ISMS, IRAP, HDS, C5, ENS, CISPE, ISO 27001, ISO 27017, ISO 27018, SOC 1, 2, and 3, PCI DSS Level 1, EU‑US Privacy Shield, and other relevant regional regulations.
When processing and storing personal data, we take the necessary legal, organizational, and technical measures to protect personal and medical data against unauthorized or accidental access, destruction, alteration, blocking, copying, provision, distribution, and other unlawful acts.
In addition to all other terms and conditions of this Agreement, you shall not:
Transfer or grant the License to any third party.
Provide any services based on the License without prior written permission.
Create more than one account or use more than one License simultaneously.

To register for our services, you are required to provide personal information. If you choose not to provide this information, we will be unable to offer you the services.
You have the option not to select a secret question and answer; however, this may limit our ability to assist you in recovering your password. You also have the option to opt out of receiving marketing emails from us. Nevertheless, you may still receive email notifications about new services, products, pricing, releases, upcoming events, and changes to the Terms of Use.
If we decide to use your personal information for purposes other than those stated in these Terms of Use, we will provide you with a clear and effective way to opt out of such use.

To the maximum extent permitted by applicable law, the right holder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or revenues, whether direct or indirect, or any loss of data, use, goodwill, or other intangible losses resulting from:
a) Your use or inability to use the Software;
b) Any unauthorized access to or use of our servers or personal information stored therein;
c) Any interruption or cessation of transmission to or from the Software;
d) Any bugs, viruses, trojans, or similar harmful components transmitted to or through the Software by a third party;
e) Any errors or omissions in content or any loss or damage incurred as a result of using content posted, emailed, transmitted, or otherwise made available through the Software; and/or
f) The defamatory, offensive, or illegal conduct of any third party.
The total liability of the right holder to you for any damages, regardless of the form of action, shall not exceed the amount of the license fee paid for one calendar month.
