We prioritize your private online privacy requirements and protect any information you share with us during our partnership in using our services for your business. Our business uses your information to help you organize your practice smoothly and provide alternative treatment reservations beyond the usual calls. As a condition of your use of our services, you agree to these terms of our Terms of Use, which may be updated from time to time.

User License (“EULA”).

All software from Dental Cloud, Inc. (Dental Cloud), is provided according to license restrictions. The End User License Agreement (“EULA” ) is part of Terms of Use and governs the use of Dentaltap software, unless it is subject to a separate agreement between you and Dental Cloud and its subsidiaries. In addition to either the EULA or such separate agreement, software is subject to the following software license information, including Additional License Authorizations (ALAs) and open source and third party license terms.

Data protection.

We make every effort to protect your data and information. What are we doing about it? We collaborate with cloud providers who fully comply with the regulations and local laws below. Data protection, processing and management in accordance with local legislation is ensured by our local installations based on the hyper-scalable IT systems in use. In this way, we avoid cross-border data transfer and ensure that data is stored in your region.

Granting a License.

If you comply with the terms of this Terms of Use, will grant you a non-exclusive, non-transferable license to use one copy of a version or release of the applicable software solely for your personal use or use within your organization. This license is subject to any pertinent information regarding the software license contained in the software products or supporting materials.

Your use of the Software is subject to the following restrictions, except as specifically permitted in the supporting materials –

    • You may not use the Software to provide services to third parties.
    • You may not make or distribute copies, resell or sublicense the software to others.
    • This Terms of Use does not convey ownership of any
      intellectual property.

We reserve the right to publish data on licensees (Company name, Logos) in marketing and PR materials on the company’s website or in relevant publications without the consent of the software user.

Limitation of Liability.

Dental Cloud’s liability to you under this agreement is limited to the amount you paid Dental Cloud for your subscription to the applicable Software for the current calendar month or limited to the balance of the prepaid monthly subscription fee paid for several calendar months. You and Dental Cloud are released from liability for lost profits, damages for downtime, damages for loss or corruption of data, and consequential, special or derivative losses or expenses.

Commencement and termination of action.

This Terms of Use between Dental Cloud and user(s) comes into effect when the user creates an account with the software.

This Terms of Use will continue in effect until it is cancelled or expires. However, your rights under this Terms of Use will terminate immediately if you fail to comply with its terms.

Warranties of Use.

We guarantee that the software functions in accordance with the documentation provided herein. The above warranty is your exclusive remedy and is in lieu of all other warranties, express or implied. The user assumes all risk of use with respect to the results and operation of the Software programs.

Free version.

Because we understand that you may not want to disclose your personal information to try out our services, we offer you the option of a free version of the software. The content you create with the free version will only be available to your account. Your sharing of personal and confidential information is secure while using the free version for a deeper understanding of the software features.

Personal Information.

During the Registration Process for creating a Account, we request for your name and email address. You will also be asked to choose a unique username and a password, which will be used solely for the purpose of providing access to your Account. Your name and email address will be used to inform you regarding new services, releases, upcoming events and changes software.

Account Usage Details.

Your Account Usage Details such as time, frequency, duration and pattern of use, features used, and the amount of storage used will be recorded by us in order to enhance your experience of the services and to help us provide you the best possible service.

Contents of your Accoun.

We store and maintain files, documents, emails, patient profiles and other data stored in your Account at in software only on servers of a vendor that meets the requirements. In order to prevent loss of data due to errors or system failures, we also keep backup copies of data including the contents of your Account. Hence, your files and data may remain on our servers even after deletion or termination of your Account. We assure you that the contents of your Account will not be disclosed to anyone and will not be accessible to our employees. Neither do we process the contents of your Account for serving targeted advertisements.

Financial Informatio.

In case of services requiring payment, we request pay card or other payment Account information, which will be used solely for processing payments. Your Financial Information will not be stored by us. Subject to your prior consent and where necessary for processing future payments, your Financial Information will be stored in encrypted form on secure servers of reputed Payment Gateway Service Provider.

How we use Internet standards and data.

Protocol address, browser type, browser language, referring URL, files accessed, errors generated, time zone, operating system and other visitor details collected in our log files to analyze the trends, administer the websites, track visitor’s movements and to improve our website.

We use temporary and permanent cookies to enhance your experience of our services. Temporary cookies will be removed from your computer each time you close your browser. By selecting ‘keep me signed-in’ option in software services, a permanent Cookie will be stored in your computer and you will not be required to sign-in by providing complete login information each time you return to our website. If you have turned Cookies off, you may not be able to use registered areas of the software.

How is medical data protected?

It remains the responsibility of the users of the software to ensure compliance with applicable laws and regulations regarding the storage and processing of personal and medical data.

We ensure the use of a secure technological environment for handling, maintaining and storing sensitive medical information – as required by HIPPA, SEC, Rule 17a-4(f), K-ISMS, IRAP, HDS, C5, ENS, CISPE, ISO 27001, ISO 27017, ISO 27018, SOC 1, 2 и 3, PCI DSS Level 1, EU‑US Privacy Shield, and other regional regulations and regulators.

When processing and storing personal data, we undertake to take the necessary legal, organisational and technical measures to protect personal and medical data against unauthorised or accidental access, destruction, alteration, blocking, copying, provision, distribution of personal data, as well as against other unlawful acts in relation to personal data.

In addition to all other terms and conditions of this Agreement, you shall not –

  • Transfer or otherwise grant the Licence to any third party.

  • Provide any services based on the Licence without prior written permission.

  • Create more than one account and use more than one License at the same time.

Your Choice in Information Use.

You will be required to register for our services by providing personal information. If you choose not to provide your personal information, we will be unable to provide you the services. We do provide you with the option of not choosing a secret question and the answer to it; however, we may be able to help you to recover your password for you. We also provide you with the option of opting out from receiving mails from us; furthermore, you will be able to receive email notifications of new services, new products, new prices, releases, upcoming events and changes to the Terms of Use. In the event we decide to use your personal information for any purpose other than as stated in this Terms of Use, we will offer you an effective way to opt out of the use of your Personal Information for those other purposes.

Updating and Removing Personal Information.

We provide users with access to their personally identifiable information. Users may correct, update or remove any such personally identifiable information either through their Software Account. Such changes may take effective right after any change is made.

Execution.

We make every effort including periodic reviews to ensure that personal information provided by you is used in conformity with this Term of Use. We will contact you to address your concerns and we will also co-operate with regulatory authorities in this regard if needed.

Notification of Changes.

Any changes to the Term of Use will be posted on our websites in order to keep you informed of any changes in nature of information collected, manner of collection, use and sharing of information. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify you by email and provide you with the ability to opt out of these new uses unless you have opted out from receiving email notifications from us.
